I. General Provisions
These General Terms and Conditions apply to the online booking of a dental treatment appointment on the premises of Stomatologické centrum Anděl, s.r.o., Radlická 2000/3, 150 00 Praha 5, through the online client reservation system operated at www.stomatologieandel.cz, or directly through the application stomatologieandel.xdent.cz (hereinafter the "reservation system"). All services provided by Stomatologické centrum Anděl, s.r.o. on the basis of online reservation of services using the internet or other online services are subject to these terms and conditions. Unless expressly agreed otherwise, these General Terms and Conditions apply to all legal acts and contractual relationships concluded online between Stomatologické centrum Anděl, s.r.o. as the provider of the reservation system and its clients as contractual partners (hereinafter the "clients").
II. Reservation, Conclusion of Contract, Order Confirmation
Clients make service reservations through the reservation system. A reservation made in this way is binding, and by completing the reservation the client concludes with Stomatologické centrum Anděl, s.r.o. a contract for the reservation of a dental treatment appointment (the reserved time of a physician or dental hygienist). Reservation prices are presented in CZK including all taxes. The appointment reservation is completed by payment through the payment gateway. Upon payment of the amount, the client acquires the right to reserve the dental treatment appointment, i.e. the client reserves the time of a physician or dental hygienist.
III. Payment Terms
Reservations made through the reservation system can be paid by payment via the payment gateway.
By paying the service price and making the reservation, the client expresses agreement with the General Terms and Conditions of Stomatologické centrum Anděl, s.r.o. for online reservations made in the reservation system.
IV. Scope of Services Provided, Changes to Ordered Services and Making Complaints
Dental services ordered via reservation in the reservation system are provided on the premises of Stomatologické centrum Anděl, s.r.o., Radlická 2000/3, 150 00 Praha 5. We recommend that the client arrive for the dental examination approximately 15 minutes in advance.
Stomatologické centrum Anděl, s.r.o. reserves the right to immediately terminate the contract with a client who is under the influence of alcohol or other addictive substances, with a client who physically or verbally attacks the staff and visitors of Stomatologické centrum Anděl, s.r.o., and who fails to comply with the visitor and operating rules of Stomatologické centrum Anděl, s.r.o. In the event of termination of the contract in such cases, the client is not entitled to a refund of the amount paid for the reservation of the appointment nor to any compensation for damages.
Stomatologické centrum Anděl, s.r.o. provides a warranty period of 24 months from the date of payment for the services sold through the online reservation system. If the purchased service is defective (i.e. does not include the ordered services), the client is obliged to assert claims for defects (a complaint) without undue delay after discovering the grounds for the complaint, either in person at Stomatologické centrum Anděl, s.r.o., Radlická 2000/3, 150 00 Praha 5 at the reception desk, or by sending an e-mail to info@stomatologieandel.cz, or by a written complaint sent by post to the address Stomatologické centrum Anděl, s.r.o., Radlická 2000/3, 150 00 Praha 5, or by telephone at +420 245 501 340. Defects discovered subsequently will not be accepted. After examining the complaint, Stomatologické centrum Anděl, s.r.o. will decide on the manner of handling the complaint within 5 business days from the date it was made. The client is obliged to provide Stomatologické centrum Anděl, s.r.o. with the necessary cooperation in handling the complaint.
V. Cancellation Terms
The client has the right to cancel the agreed appointment no later than 24 hours in advance by telephone at +420 245 501 340, and no obligations arise for the client from cancelling the appointment. The client has the right to use the amount paid for reserving the dental treatment appointment towards payment of direct charges arising from the dental treatment provided, if such charges arise as part of the treatment. If no direct charges arise from the dental treatment provided, i.e. if the treatment is fully covered by health insurance, the paid amount is refunded to the client in full to the account from which it was paid. If the client does not attend the agreed dental treatment appointment and does not cancel their reservation at least 24 hours in advance, Stomatologické centrum Anděl, s.r.o. reserves the right to charge a fee for the missed dental examination/treatment, i.e. compensation for lost profit in the amount paid for the reserved appointment.
In the event of the inability to use the reserved dental treatment appointment due to:
- a) Force majeure: The client is entitled to use the paid service in full at a substitute appointment. If the client requests a refund for the paid service, the value of the service will be refunded to the account from which it was paid.
- b) On the part of Stomatologické centrum Anděl, s.r.o.: The client is entitled to use the paid service in full at a substitute appointment. If the client requests a refund for the paid service, the value of the service will be refunded to the account from which it was paid.
VI. Processing and Retention of Personal Data
The client agrees that the personal data provided will be processed and stored by the seller in accordance with the Personal Data Protection Act (Act No. 101/2000 Coll.) for the purpose of fulfilling the subject matter of the contract. The client has the right to be informed of what data about them the seller keeps on record, and is entitled to change such data or express in writing their disagreement with its processing. Supervision over personal data protection is carried out by the Office for Personal Data Protection. The client may notify the seller that they wish to stop receiving commercial communications, to the e-mail address obtained in connection with the performance of the contract, without incurring any costs.
VII. Effectiveness
These General Terms and Conditions are effective as of 1 October 2024.
If individual provisions of these General Terms and Conditions are or become ineffective, this shall not affect the effectiveness of the other provisions or the entire legal act. An ineffective provision must be replaced by a provision that most closely corresponds to the purpose of the ineffective provision. Any changes to these General Terms and Conditions must be made in writing. Stomatologické centrum Anděl, s.r.o. is entitled to amend the General Terms and Conditions unilaterally.
VIII. Final Provisions
All arrangements between the seller and the buyer are governed by the laws of the Czech Republic. If the relationship established by the purchase contract contains an international element, the parties agree that the relationship shall be governed by the law of the Czech Republic. This does not affect the consumer's rights arising from generally binding legal regulations.
All rights to the seller's website, in particular copyright to the content, including the layout of the page, photographs, videos, graphics, trademarks, logo and other content and elements, are the property of Stomatologické centrum Anděl, s.r.o. It is prohibited to copy, modify or otherwise use the website or any part thereof without consent. Stomatologické centrum Anděl, s.r.o. is not liable for errors arising as a result of interference by third parties in the internet reservation system or as a result of its use contrary to its purpose. When using the online store, clients must not use procedures that could negatively affect its operation and must not carry out any activity that could enable them or third parties to unlawfully interfere with or unlawfully use the software or other components forming the internet reservation system or its parts or software equipment in a manner contrary to its purpose. If they do so, they assume the risk of a change of circumstances within the meaning of Section 1765(2) of the Civil Code.
The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible. Stomatologické centrum Anděl, s.r.o. may amend or supplement the wording of the terms and conditions. This provision does not affect rights and obligations arising during the period of effectiveness of the previous wording of the terms and conditions.
